The Swiss franc law is getting closer. The draft has been adopted by the Standing Committee of the Council of Ministers.

The Court of Justice of the European Union issued a judgment in the case of Getin Noble Bank and Swiss franc borrowers TVN24

On July 25, the Standing Committee of the Council of Ministers approved the draft Swiss franc legislation and recommended it to the Council of Ministers. The new rules aim to accelerate and simplify the procedures in cases involving Swiss franc loans.

„(…) I am submitting a draft law on special measures for resolving cases related to credit agreements made with consumers that are denominated or indexed to the Swiss franc, accompanied by justification and an assessment of the regulatory impact (…). The draft was adopted and recommended to the Council of Ministers by the Standing Committee of the Council of Ministers during the meeting on 25 July 2025,” it was noted.

The government’s adoption of the bill was initially scheduled for the second quarter of this year.

The intended new regulations aim to simplify and speed up the handling of Swiss franc cases, which in turn is expected to alleviate the burden on courts and shorten the time required for other types of cases as well. The Ministry of Justice anticipates that the law will take effect in 2025, with a 14-day vacatio legis.

Modifications for Swiss franc borrowers

As per the bill, consumers taking legal action against banks will not need to file requests for security, including the suspension of installment payments – the suspension will occur automatically by operation of law.

The proposal also seeks to extend the possibility of adjudicating in closed sessions at both the first and second instance, as well as to allow the submission of a request for the resolution of a counterclaim within a single court proceeding.

Moreover, the bill introduces measures to encourage out-of-court settlements, including fiscal advantages for parties who opt not to proceed with further litigation.
