The government has adopted a draft of penalties for drifting and stunts on motorcycles.

On Tuesday, the government approved a draft amendment to the regulations aimed at enhancing road safety. The updated rules incorporate, among other things, stricter penalties for drifting vehicles and performing stunts on motorcycles. For obstructing traffic during unlawful gatherings, the minimum fine will be PLN 10,000.

The proposed modifications to certain laws by the Ministry of Justice to bolster road safety also entail increased penalties for reckless and hazardous driving, with repeat offenders and individuals with multiple driving bans expected to be removed from roadways, as announced by the Chancellery of the Prime Minister.

Sanctions for unlawful racing and drifting

The draft includes a definition of an unlawful race – a competition involving at least two drivers aiming to traverse a specific stretch of road in the shortest time possible while violating road safety laws. Drifting will also incur penalties – „deliberately making a vehicle skid or losing contact with the road surface, even with one wheel, performed during a public gathering without the necessary permit.”

The Chancellery of the Prime Minister emphasized that the regulation will also apply to motorcyclists who ride on one wheel.

Organizing or taking part in unlawful races will lead to a prison sentence ranging from 3 months to 5 years – this does not extend to spectators; the same sentence will also apply for operating a vehicle outside of an unlawful race in a reckless and dangerous fashion – the Chancellery of the Prime Minister noted in a statement regarding the Council of Ministers’ decisions. Such penalties will apply, among others, for serious breaches of road safety, exceeding the speed limit by at least half on a motorway or expressway or at least double on another road, thereby posing a threat to another person’s safety.

„This indicates that a prison term of 3 months to 5 years will be imposed on a driver who travels, for instance, on a motorway at a speed of at least 210 km per hour, or on an expressway, exceeding 180 km per hour, while simultaneously grossly violating safety regulations and jeopardizing another person’s safety through their conduct,” the Law Firm explained, providing details about the project.

Up to a decade in prison

The new provisions suggested by the government also stipulate that if a driver causes a fatal accident or inflicts severe harm to another individual, they will face a prison sentence ranging from one to 10 years. „This clause will apply to individuals involved in unlawful racing, operating a vehicle recklessly, or breaching a driving ban,” added the Chancellery of the Prime Minister. The regulations regarding vehicle confiscation are also being strengthened – this will also be applicable if the offender was sober but operated the vehicle despite an existing ban. Recidivists with multiple driving bans will be removed from road traffic – only in particularly justified situations will the court be allowed to conditionally suspend the enforcement of a prison sentence imposed for violating the driving prohibition. Should a conviction occur for disregarding a driving ban ruling after the amendments take effect, the court will have the authority to impose a lifetime ban.
