Świrski's „inaction” from the National Broadcasting Council with a „flagrant violation of the law”. There is a verdict

The Provincial Administrative Court in Warsaw determined that Maciej Świrski, the Chairman of the National Broadcasting Council, failed to act regarding the allocation of funds to TVP SA for fulfilling its public mission from January to September 2024, resulting in a penalty of PLN 50,000.
On Monday, the Provincial Administrative Court in Warsaw revealed that the decision was made during a closed session on April 9 of this year.
This was prompted by „a complaint from Telewizja Polska SA in liquidation concerning the inactivity of the Chairman of the National Broadcasting Council about the fund transfer for the public mission’s execution”.
Świrski’s „inaction”
The court concluded that „the inaction of the Chairman of the National Broadcasting Council constituted a severe breach of the law” and „imposed a penalty of PLN 50,000 on the Chairman of the National Broadcasting Council”.
Moreover, it awarded Telewizja Polska SA in liquidation, based in Warsaw, an amount of PLN 30,000.
The involved parties will have the chance to appeal to the Supreme Administrative Court within 30 days following the receipt of a copy of the judgment along with the justification.
„Because the judgment was rendered in a simplified procedure during a closed session, the reasons behind the judgment will be available once the justification for the case is finalized,” the Provincial Administrative Court stated.
It was decided to place the funds in a depository
In 2024, the National Broadcasting Council halted the transfer of subscription fees owed to TVP for the financing of the public mission. It was decided that the council would deposit the funds in a court depository instead of sending them directly to public radio and television organizations. The council attributed this to „the legal confusion arising within public radio and television entities due to decisions made by the Minister of Culture and National Heritage”.
Last autumn, the National Broadcasting Council, referencing the September flooding, opted to disburse funds to television, with a significant portion directed to regional TVP centers.
At the time of publication, the National Broadcasting Council did not provide a response to a request for comment.
