Land and mortgage registers can be searched in mObywatel

The Ministry of Justice aims for the mObywatel application to facilitate the retrieval of information from the National Court Register and land and mortgage registers using the PESEL number. This enhancement will allow users to more conveniently verify details regarding companies and properties.
The proposed amendment to the Act on Land and Mortgage Registers and the Act on the National Court Register, overseen by Arkadiusz Myrcha, the deputy head of the Ministry of Justice, was included in the government agenda this past Friday.

The suggested modifications allow for the independent retrieval of electronic documents from the Central Information Centre for Land and Mortgage Registers. This will enable users to download copies of land and mortgage registers, extracts, and closure certificates in electronic form from the CI KW IT system, granting these documents the same validity as those issued by a court.
Additional modifications focus on expanding the use of the mObywatel application. This includes the ability to search land and mortgage registers freely with the PESEL number and data from the National Court Register (KRS) for entities listed in the register, aimed at simplifying and enhancing the efficiency of database navigation.
The initiative is designed to provide access to data from the National Court Register (KRS) concerning entities registered as entrepreneurs or in the register of associations, social and professional organizations, foundations, and independent public healthcare institutions—particularly regarding case registration in the IT system or making an entry in a Register item, if they pertain to data linked to a user’s PESEL number.

„Documents made available by the Central Land and Mortgage Register Information Service for self-printing via the IT system prior to the Act’s effective date will maintain their validity if they include features that allow their verification against the data in the central land and mortgage register database,” the list of legislative efforts indicates.
Furthermore, expanding the mObywatel application’s functionality will necessitate an amendment to the regulation by the Council of Ministers from July 2023 regarding the data scope and the list of public registers and IT systems of public entities from which mObywatel users can obtain data.
Part of the deregulation package
The proposed regulations, which form part of the deregulation initiative, are set to take effect on March 31, 2026. This timeline is influenced by the objectives of the „Development and Increased Accessibility of Court Registers – eKRS and EKW” project, which is included in the National Recovery and Resilience Plan. The government is anticipated to approve the bill in the third quarter of this year.
