Rafał Brzoska discusses the necessity for deregulation and the TVN tax legislation

The Council of Ministers has approved a resolution aimed at coordinating the deregulation process, as reported by the Government Information Centre. Furthermore, a dedicated team has been formed within the Prime Minister’s office, to be led by Minister Maciej Berek.

„The Council of Ministers has approved a resolution on the coordination of the legislative process executing deregulation, presented by Minister – Member of the Council of Ministers Maciej Berek,” the Chancellery of the Prime Minister’s website stated.

Additionally, it was noted that the government intends to conduct assessments of the current legal framework, particularly concerning the conditions for operating business activities, and to initiate measures for deregulation.

New team

„For this purpose, a specialized team has been established in the Chancellery of the Prime Minister, led by Minister Maciej Berek,” it was mentioned.

The responsibilities of this team include coordinating the legislative process regarding government draft documents that implement deregulation, which entails initial analyses of suggested legislative solutions.

The team also comprises the ministers of finance, development and technology, along with the president of the Government Legislation Centre.

Team and representative for deregulation

On February 10 this year, during the conference „Poland. A Year of Breakthrough”, Prime Minister Donald Tusk invited Rafał Brzoska, a Polish entrepreneur and founder and president of Inpost, to form a team that would swiftly prepare proposals for deregulation. This team is made up of entrepreneurs rather than politicians or civil servants.

At the end of February, the deregulation team led by Rafał Brzoska released its initial proposals for legal amendments aimed at enhancing the operation of Polish businesses. The recommendations included increasing the frequency of general interpretations issued by the Minister of Finance, modifying ESG reporting obligations, curbing abuses by tax authorities, such as minimizing tax disputes, not penalizing for inadvertent errors, limiting VAT penalties, adopting less aggressive enforcement practices, and leveraging the potential of artificial intelligence.

The Ministry of Development and Technology is also developing a deregulation package; since January of last year, a representative for deregulation has been functioning within the Ministry of Development and Technology, tasked with supporting efforts related to deregulation in economic law and facilitating economic dialogue.
