A new law took effect on Thursday, prohibiting the sale of heated tobacco products with a distinctive scent. Producers and vendors are given nine months to comply with the updated regulations.

This amendment to the Act on the Protection of Health Against the Consequences of Tobacco Use and Tobacco Products, dated 21 February, aligns with the EU directive that Member States are required to implement by 23 October 2023.

The updated regulations ban the circulation of heated tobacco products that have a characteristic aroma. According to the law, these products may continue to be sold for a maximum of 9 months following the law’s enactment, which means until the latter part of January next year.

Data from the European Commission shows that the sales of heated tobacco products have surged by 2009% in recent years, with their overall market share within the tobacco sector of the European Union currently at 3.33%.

Limitations on e-cigarette sales

The Sejm is currently discussing another government proposal to revise the so-called Tobacco Act, which aims to restrict the sale of e-cigarettes.

The initiative, developed by the Ministry of Health, prohibits the sale of all varieties of electronic cigarettes and refill containers to individuals under 18 years old, regardless of whether the products contain nicotine.

This proposal is presently at the notification stage with the European Commission.
