The Central Communication Port company has thus far acquired just over half of the land designated for the new airport, as reported by the government’s representative for CPK, Maciej Lasek. He expressed hope that new regulations will be enacted by the end of June to expedite the investment process.

– Reviewing the area, we have secured over 50 percent of the land needed for the future airport. For the owners of this 45 percent of land designated for the airport, we have prepared an amendment to the CPK Act – stated the government’s plenipotentiary for CPK and Deputy Minister of Infrastructure, Maciej Lasek.

This pertains to a proposed amendment to the Act on the Central Communication Port, the principles of which were made public this week in the government’s legislative work schedule.

85 percent advance compensation

– The act we have formulated addresses the expectations of property owners who have not participated in the Voluntary Acquisition Program. We are meeting their needs. These individuals were primarily concerned about the lengthy wait for compensation during the expropriation process, and we aim to offer that before they relinquish their property, they will receive 85% of the advance compensation determined by the governor. Whether they might receive more in court will, of course, depend on their arguments – remarked Lasek.

He further noted that once the location decision is finalized, the CPK company will assume ownership of the land and the expropriation process will commence.

The amendment also introduces regulations designed to streamline the investment process. The CPK company will be allowed to begin preparations for construction work sooner, particularly in terms of administrative arrangements. This includes securing the necessary documents, such as building permits.

The representative underscored that the existing CPK Act does not specify the procedure for expropriation concerning the future airport.

– It is well-known that expropriation typically poses the greatest challenge for any public purpose investment. Therefore, we have drafted an act that details this process while simultaneously proposing regulations that are advantageous for both the residents of the future investment areas and CPK – explained Maciej Lasek.

He added that over the past year, the company has been focused on acquiring as many properties as possible for the CPK through the Voluntary Acquisition Program.

– We have achieved significant success. The program garnered substantial interest. We acquired nearly 95 percent of all inhabited, developed properties within the future airport site. For me, this is one of the most crucial aspects, as from a human perspective, the individuals who resided there reached agreements with the company and sold their properties for the best offer available. They can now purchase or build elsewhere; they received their funds immediately, and the deadlines for vacating the property were set at half a year, and in one case, even a year – stated Lasek.

He pointed out that this does not apply to all properties.

– A small fraction of owners opted to wait for the expropriation procedure. This is particularly true for the owners of agricultural land. There are still approximately 20 developed properties in the entire area where the owners have not signed agreements with the company regarding PDN. In the interest of these individuals, we decided that the act should be modified to offer them better conditions – remarked the proxy.

He recalled that, according to the current CPK Act, once the location decision issued by the governor becomes final and binding, the company takes possession of the land, and the governor only has a set period to determine the amount of compensation owed to the dispossessed individual.

– We have proposed an alternative solution – that the governor, at the moment the location decision becomes final or when the company requests immediate enforceability, must assess the value of compensation within 30 days. This way, everyone, before transferring their property, is entitled to at least 85% of the advance payment of this compensation – clarified Lasek.

In his view, „the current CPK Act had the most unfavorable expropriation conditions among all special acts.” – Together with the company, we spent several months developing solutions to protect residents – he stated.

Lasek added that the project also aims to clarify the provisions concerning compensation payments and the possibility of expediting related investments.

The plenipotentiary emphasized his desire for the project to be swiftly presented to the government for review and then to parliament.

– The time remaining to issue a legally binding location decision is becoming limited. We anticipate it will occur in the third quarter of this year. It would be very beneficial if the act were to take effect and be signed by the president by the end of the second quarter – stated Lasek.
